PROMOTION DESCRIPTION:  The Adopt-a-Pet.com “Seresto® Circle of Love” social contest (the “Contest”) begins on or about April 9, 2019, at 12:01 a.m. Pacific Time (“PT”) and ends at 11:59 p.m. PT on April 23, 2019 (the “Contest Period”). To enter the Contest, rescue organizations or shelters must apply on Adopt-a-Pet.com and fill out the optional social media section (each application, a “Submission”). Applications will be accepted from February 20, 2019 at 12:01 a.m. Pacific Time (“PT”) and ends on March, 20, 2019 at 11:59 p.m. PT (the “Application Period”). Once the Application Period is concluded, Adopt-a-Pet will choose two (2) finalists from all Submissions to advance to the Contest; each finalist being a being a “Nominated Organization.” Adopt-A-Pet will post the two (2) Submissions of the Nominated Organizations which it has chosen to advance from the application process on Adopt-a-Pet.com’s following accounts: Facebook  at https://www.facebook.com/Adoptapetcom/ , Instagram at https://instagram.com/adoptapetcom/ , and Twitter at https://twitter.com/AdoptaPetcom and users will be able to vote on these social channels for their favorite Submission.  At the end of the Contest Period, one (1) grand prize winner will be selected and one (1) second place prize will be awarded as the runner-up. The grand prize and second place prize are hereinafter collectively and individually referred to as “Prize.” By participating in the Contest, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Humane America Animal Foundation, d/b/a Adopt-a-Pet.com, 310 N. Indian Hill Blvd., #800, Claremont‎, CA ‎ 91711, (“Sponsor”), which shall be final and binding in all respects.

SOCIAL MEDIA: The Contest hosted by Adopt-aPet.com is in no way sponsored, endorsed, administered by, or associated with Instagram, Facebook, or Twitter. Attempted entry via Instagram, Facebook, and/Twitter are not eligible Submissions. ELIGIBILITY:  Participation in the Contest is open only to organizations or shelters that (i) have completed a Submission during the Application Period (ii) operate within the fifty (United States) and/or the District of Columbia, (iii) are located in the U.S., (iv) are currently registered 501(c)(3) organization belonging to Adopt-a-Pet’s network and (v) are currently listing pets on Adopt-a-Pet.com .   .  Officers, directors and employees of Sponsor and its parents, subsidiaries, licensors, distributors, retailers, sales representatives, advertising and promotion agencies (all such entities and individuals referred to collectively herein as the “Related Entities”), and the immediate family members and/or those residing in the same household of each are ineligible to enter the Contest. . Representatives from each winner must sign and return a release and affidavit of eligibility, which must be received within fourteen (14) days of notification. The representatives Each winner must show proper identification to claim prizes on behalf of their Nominated Organization.  Adopt-a-Pet.com reserves the right to examine additional documentation and may choose to accept or deny awarding the Prize to the winning Nominated Organization based on the identification or documentation presented. Related Entities, together with Bayer HealthCare LLC, its officers, directors, employees, and affiliates (“Bayer”)  are hereinafter collectively referred to as “Promotion Entities.”

HOW TO ENTER:  Each eligible organization or shelter must complete a Submission during the Application Period. Adopt-a-Pet will choose two (2) finalists from all Submissions to advance to the Contest. Adopt-A-Pet will post the two (2) Submissions of the Nominated Organizations which it has chosen to advance from the application process on Adopt-a-Pet.com’s abovementioned social media accounts. During the Contest, social media users view Adopt-a-Pet.com’s Instagram story highlight titled “Seresto Grant” and choose the Nominated Organization they would like to receive the grand prize. To participate on Facebook and/or Twitter, social media users view Adopt-a-Pet.com’s page and vote in the poll (pinned to the top of the page) for the Nominated Organization they would like to receive the grand prize. Individuals may submit three (3) votes, by voting once each in the Instagram, Facebook, and Twitter polls. Votes must be received by the end of the Contest Period.  Any personal information collected by Sponsor in connection with voting in the Contest will be used in accordance with its online privacy policy, located at http://www.adoptapet.com/public/privacy_policy. Proof of Submission is not considered proof of delivery to or receipt of such entry.  Sponsor shall have no liability for any Submission that is lost, intercepted or not received by the Sponsor.

WINNER SELECTION: Sponsor, in its sole discretion, will select the two (2) Submissions from all eligible Submissions received during Application Period to advance to the Contest. Sponsor will choose the advancing Submissions based on a variety of criteria including, but not limited to, engagement, follower count, and eligibility of the organization making a Submission. Adopt-A-Pet will post the two (2) advancing Nominated Organizations on Adopt-a-Pet.com’s abovementioned Facebook, Instagram, and Twitter pages and eligible users will be able to vote on these social channels for their favorite Nominated Organization. The grand prize winner will be chosen by Sponsor, in its sole discretion, based on the number of votes received during the Contest. The second-place winner will be the runner-up in the Contest. The Nominated Organizations receiving a Prize will be notified through email within seven (7) calendar days of the end of the Contest Period. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by the Nominated Organization for any reason. If any potential winner does not respond within the time required by Sponsor, or if the winner notification is returned as unclaimed or undeliverable to any potential winner, such potential winner will forfeit his or her Submission and an alternate Submission may be selected by Sponsor at its sole discretion, to receive the Prize.

REPRESENTATIONS AND WARRANTIES/INDEMNIFICATION:  Each eligible organization making a Submission hereby agrees to indemnify and hold the Promotion Entities harmless from and against any and all third-party claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses relating to or arising out of any breach or alleged breach of any of the warranties, representations or agreements of entrant hereunder.

 

PUBLICITY RELEASE:  By making a Submission, in addition to any other rights which may be granted in any other agreement entered into between Sponsor and any eligible organization or shelter making a Submission the organization and/or shelter thereby irrevocably grants the Promotion Entities and their respective affiliates, successors, assigns and licensees, the right to use  the organization’s or shelter’s name, likeness, service marks (including trademarks), and Submission, including any those of individual(s) participating therein or representatives thereof, in any and all media for any lawful purpose, including without limitation, advertising and promotional purposes as well as in, on or in connection with the Contest or other promotions, and hereby releases the Promotion Entities from any and all liability with respect thereto. By making a Submission participating eligible organizations and/or shelters represent and warrant that they have the legal rights to transfer the abovementioned rights to the Promotion Entities.

PRIZES/ODDS: Nominated Organizations receiving a Prize, and representatives thereof, may be featured on the Promotional Entities’ websites and social media channels. The Nominated Organization receiving the grand prize will receive seventy eight (78) units of Bayer® Seresto® flea and tick prevention. The Nominated Organization receiving the second place prize will receive thirty (30) units of Bayer® Seresto® flea and tick prevention. The approximate retail value of the grand Prize provided to the winning organization is $3,500. The approximate retail value of the second place Prize provided to the winning organization is $1,500. Prizes are nontransferable. Odds of winning depends on the number of eligible Submissions received.

GENERAL PRIZE CONDITIONS:  No cash alternative or prize substitutions will be allowed, except Sponsor reserves the right to substitute Prize(s) or opportunities or comparable out-of-pocket cost value if any Prize or opportunity listed is unavailable, in whole or in part, for any reason.  The Nominated Organizations shall be solely responsible for all federal, state and/or local taxes, and the reporting consequences thereof, and for any other fees or costs associated with the Prize.

 

GENERAL LIABILITY RELEASE/FORCE MAJEURE: Eligible organizations and/or shelters making a Submission each hereby agree that the Sponsor, Bayer, Instagram, Twitter, and Facebook (a) shall not be responsible or liable for any losses, damages or injuries of any kind (including death) resulting from making a Submission or participation in the Contest, or from Nominated Organizations’ acceptance, receipt, possession, and/or use or misuse of any Prize, and (b) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any Prize, including, without limitation, to such Prize’s quality or fitness for a particular purpose, and (c) shall not be liable for any typographical or other error in the printing or promotion of the Contest or the Prizes, the administration of the Contest, or the announcement of the Nominated Organizations and/or Prize winners, including an erroneous indication that a Prize may have been won. Each eligible organization and/or shelter making a Submission will indemnify, defend and hold harmless the Promotion Entities, Instagram, Twitter, and Facebook from and against all third-party claims arising out of or relating to the organization’s and/or shelter’s participation. Promotion Entities, Instagram, Twitter, and Facebook assume no responsibility for any damage to an entrant’s computer system which is occasioned by accessing Instagram, Twitter, Facebook any Promotion Entity website or by participating in the Contest.  Sponsor reserves the right in its sole discretion to disqualify any individual, organization, shelter, and/or Nominated Organization who is found to be tampering with the entry process or the operation of the Contest, Instagram, Twitter, Facebook, or a Promotion Entity website, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Contest, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.  These Official Rules cannot be modified or amended in any way except in a written document issued in accordance with the law by a duly authorized representative of Sponsor and/or Bayer HealthCare LLC.  The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision.  In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

DATES & DEADLINES/ANTICIPATED NUMBER OF CONTESTANTS:  Because of the unique nature and scope of the Contest, Sponsor reserves the right, in addition to those other rights reserved herein, to modify any date(s) or deadline(s) set forth in these Official Rules or otherwise governing the Contest.  Sponsor cannot accurately predict the number of entrants who will participate in the Contest.

 

GOVERNING LAW/JURISDICTION:  ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE CONTEST SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF CALIFORNIA WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OF CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S LAWS.

 

WINNERS LIST/OFFICIAL RULES:  To obtain a copy of any legally-required winners list, send a self-addressed stamped envelope to 310 N. Virtual "Pooch Protest" Launches Today

Campaign garners donations of much-needed flea and tick treatment to animal shelters nationwide

An innovative national campaign designed to educate the public about the dangers of fleas and ticks while helping animal shelters protect the dogs in their care against the troublesome parasites launches today. In addition to its national online presence, the “Pooch Protest” campaign is featured on billboards which will begin in Charlotte, North Carolina, and then roll out to Raleigh/Durham, North Carolina, and Philadelphia, Pennsylvania.

The “Pooch Protest” against fleas & ticks, a partnership between Bayer Animal Health and national pet-adoption charity Adopt-a-Pet.com, invites the public to visit http://www.PoochProtest.com, where they can register their dogs as members of the virtual protest. For every dog registered*, Bayer Animal Health, the makers of flea and tick preventive K9 Advantix® II, will donate a tube of the product to Adopt-a-Pet.com, who will, in turn, distribute the tubes to its member shelters and rescue groups across North America.

“Protecting pets in shelters from nasty parasites and pests is important for so many reasons,” says Adopt-a-Pet.com executive director Abbie Moore, “not the least of which is that a healthy pet, treated for fleas and ticks and other pests, is much more attractive to potential adopters. Treating with a flea and tick preventive can truly help to keep a shelter pet more comfortable and adoptable.”

Animal Ark Rescue

Who they are: “We are a no-kill animal rescue in Columbus, GA willing to do whatever it takes to save lives and get animals adopted!”

One volunteer said, “It is our hope to use this grant for our shelter animals and then send them with their Seresto® collars into loving forever homes.” Animal Ark Rescue shared two examples of pets that would have greatly benefitted from Seresto® collars:

“Jewel’s Journey to Recovery: We received an urgent call from Columbus Animal Control about a pup with an embedded chain. We rushed to get her and were shocked at her condition. She was found wandering the streets at night thank God she got away from where she was completely covered in thousands of fleas and nothing but skin and bones. Jewel was only about 10 months old and was held in complete horror by the people that had her. After a 30-minute bath she was rushed to the Vet to be sedated to remove the chain that was deeply embedded in her neck. She was licking our faces as to say thank you during the bath to get the fleas off of her. Jewel went straight from the vet to a foster home where she quickly recovered.” Jewel is just another example of why having flea prevention on board is so important.

“Paxton’s Second Chance: Baby Paxton transferred in to us from Animal Control and had to be rushed to the vet. His gums were pale white, his temperature was too low, and his body was shutting down. He is extremely anemic from a severe flea infestation and muzzle swollen due to flea allergy. Paxton needed an immediate blood transfusion to stabilize him. The fleas had ingested so much of his blood that he would have died without our immediate intervention. Our shelter is in South Georgia where flea and tick season is yearlong.” Paxton survived (and is now happy and healthy in his forever home), but a Seresto® collar could have helped prevent biting fleas from infesting him.

 

Second Chance Animal Shelter

Who they are: “We are a no-kill animal shelter located in MA. We work hard to keep pets out of shelters. Through our many programs, we help over 37,400 pets a year.”

Blackhawks Player Raises Awareness for Pitbulls in New Billboard Campaign

CHICAGO – Blackhawks Left Winger Bryan Bickell has a message for Chicagoland residents: Learn the truth about pitbulls and adopt one today!

Bryan Bickell and fiance, Amanda Caskanette have partnered with Found Chicago and Adopt-a-Pet.com for a campaign aimed at debunking myths about pitbulls and raising awareness for shelter pets.

Beginning this week, Chicagoland residents will see a billboard featuring Bryan and Amanda with their pitbull, Bailey, in Streeterville along with televised public service announcements. A second billboard will go up in Lakeview later this month.

“Pitbulls and other dogs that look like them are discriminated against because most people don’t know the truth,” states Bickell.

“We’re excited to join forces with a great organization like Found Chicago, and with Bryan Bickell, to educate people about the true, loving nature of pitbull-type dogs,” says Abbie Moore, executive director of Adopt-a-Pet.com. “It’s our collective hope that the billboards and the public service announcements will make people give these maligned dogs a second look. Both the Backeses and the Buehrles are extremely active in companion-animal welfare issues. David and Kelly Backes both serve on the board of directors of the St. Charles Humane Society, where Kelly is Vice President of the shelter.
